Federal Financial Services Act

(LSFin)

The Federal Financial Services Act (FinSA) came into force on 1 January 2020 with transitional periods of up to 2 years in order to comply with certain requirements. This Act seeks to protect the clients of financial service providers and to establish comparable conditions for the provision of financial services by financial service providers.

The requirements of the FinSA are being applied in BNP Paribas (Suisse) SA. The Bank will comply with the rules of conduct and organisational measures required by law by no later than the end of the transitional periods.
The FinSA is applicable whenever financial services are provided professionally in Switzerland or to clients in Switzerland.

The Swiss Financial Market Supervisory Authority (“FINMA”) supervises BNP Paribas (Suisse) SA, which is a subsidiary of BNP Paribas S.A. and subject to the Swiss Federal Banking Act (“BA”)

BNP Paribas (Suisse) SA has two branches, one in Zurich and the other in Lugano, as well as two subsidiaries, one in Monaco and the other in the United Arab Emirates.

Client classification

Under the FinSA, clients of financial service providers are classified under one of the following three categories: “private”, “professional” or “institutional”. The level of protection is determined by the client’s category, with “private” clients benefiting from the highest level of protection.

Depending on certain criteria (e.g. a client’s net worth, level of knowledge and/or experience in the financial sector), a client may ask for a change of category in order to have a higher protection or access to additional financial products and/or services involving reduced protection.
